1. Acceptance of Terms

By downloading, installing, accessing, or using RecipeAI (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users of the Service, including both free and premium subscribers.

2. Description of Service

RecipeAI is an AI-powered recipe generation and management platform that provides the following features:

• AI Recipe Generation: Generate personalized recipes from food images using artificial intelligence technology
• Multiple Generation Modes: Single recipe generation, multiple recipe variations, and batch processing capabilities
• Calorie Calculation: Analyze food images to estimate caloric content and nutritional information
• Recipe Management: Save, organize, edit, and manage your generated and custom recipes
• Favorites System: Mark recipes as favorites for quick access and retrieval
• Recipe Search: Search through your saved recipes and discover new meal ideas
• Personalization: Set dietary restrictions, allergies, preferred cuisines, and cooking preferences
• Recipe Customization: Edit ingredients, instructions, cooking times, and servings for any recipe
• Image Enhancement: Regenerate recipe images with AI-powered visual improvements

3. Account Registration and Authentication

3.1 Account Creation

To use RecipeAI, you must create an account using one of the following methods:

• Email and password registration
• Google account authentication (OAuth)
• Apple account authentication (Sign in with Apple)

3.2 Account Requirements

• You must be at least 13 years of age to create an account and use the Service
• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must immediately notify us of any unauthorized use of your account
• One person or entity may not maintain more than one account without our permission

3.3 Account Security

You agree to safeguard your password and to notify RecipeAI immediately if you become aware of any unauthorized access to your account. RecipeAI will not be liable for any loss or damage arising from your failure to maintain account security.

4. Subscription Plans and Billing

4.1 Service Tiers

RecipeAI offers both free and premium subscription tiers:

• Free Tier: Limited monthly recipe generations with access to basic features
• Premium Subscription: Unlimited or significantly increased generation limits, plus access to premium features and priority support

4.2 Generation Limits

Free accounts are subject to monthly generation limits that reset automatically at the beginning of each calendar month. Premium subscribers receive significantly higher or unlimited generation capabilities. Specific limits are displayed within the application and may be adjusted at our discretion.

4.3 Payment Processing

Premium subscriptions are processed through Stripe, our third-party payment processor. By subscribing, you agree to Stripe's Terms of Service. You authorize RecipeAI to charge your selected payment method on a recurring basis according to your subscription plan.

4.4 Subscription Billing

• Subscriptions are billed on a recurring basis (monthly or annually, depending on your selected plan)
• Your subscription will automatically renew unless cancelled before the renewal date
• You will be charged at the beginning of each billing period
• Pricing may change with 30 days advance notice to existing subscribers
• You are responsible for maintaining valid payment information

4.5 Cancellation and Refunds

• You may cancel your subscription at any time through the app or customer portal
• Cancellations take effect at the end of your current billing period
• You will retain premium access until the end of your paid period
• No partial refunds are provided for unused time within a billing period
• Refunds for billing errors will be provided at our discretion
• If you cancel, your account will revert to the free tier with applicable generation limits

4.6 Free Trial (if applicable)

If we offer a free trial period, you will not be charged until the trial period ends. You may cancel at any time during the trial to avoid charges. If you do not cancel before the trial ends, your payment method will be charged for the subscription.

5. User Content and Uploaded Images

5.1 Your Content

You retain ownership of all content you submit to RecipeAI, including photographs, images, recipe modifications, and custom recipes. By uploading content, you represent and warrant that:

• You own or have the necessary rights to the content you upload
• Your content does not violate any third-party rights, including intellectual property rights
• Your content does not contain illegal, harmful, or offensive material
• Your images are of food and appropriate for recipe generation purposes

5.2 License to RecipeAI

By uploading content to RecipeAI, you grant us a worldwide, non-exclusive, royalty-free, transferable license to:

• Process your images through our AI systems to generate recipes
• Store your content on our servers and cloud infrastructure
• Display your saved recipes and images back to you within the application
• Use your content to improve our machine learning models and service quality (anonymized and aggregated)

This license terminates when you delete content from your account, except for backup copies retained for technical purposes for a reasonable period.

5.3 Image Processing

Images you upload are processed using third-party artificial intelligence services (including OpenAI) to generate recipe content. By using the Service, you consent to this processing and understand that AI-generated content may vary in accuracy and quality.

6. AI-Generated Content

6.1 Content Accuracy Disclaimer

Recipes, nutritional information, and calorie estimates generated by RecipeAI are created using artificial intelligence and should be used as suggestions only. We do not guarantee the accuracy, completeness, or safety of AI-generated content. Users should:

• Exercise independent judgment when following recipes
• Verify nutritional information if dietary precision is critical
• Be aware of personal allergies and dietary restrictions
• Consult healthcare professionals for medical dietary advice
• Practice safe food handling and cooking procedures

6.2 No Medical or Nutritional Advice

RecipeAI does not provide medical, nutritional, or dietary advice. Calorie estimates and nutritional information are approximations only and should not be relied upon for medical purposes. Consult qualified healthcare professionals for dietary and nutrition guidance.

6.3 Food Safety

You are solely responsible for food safety, proper cooking techniques, and verifying that recipes are safe for consumption. RecipeAI is not liable for any foodborne illness, allergic reactions, or health issues arising from recipes generated or stored on the platform.

7. Acceptable Use Policy

7.1 Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Upload content that infringes on intellectual property rights of others
• Upload images that are not food-related or appropriate for recipe generation
• Attempt to reverse engineer, decompile, or hack the application
• Use automated scripts, bots, or tools to access the Service
• Circumvent generation limits or subscription requirements
• Share your account credentials with others
• Resell, redistribute, or sublicense access to the Service
• Upload malicious code, viruses, or harmful content
• Impersonate others or misrepresent your affiliation
• Harass, abuse, or harm others through the Service
• Interfere with or disrupt the Service or servers

7.2 Content Moderation

We reserve the right to review, remove, or refuse any content that violates these Terms or is otherwise objectionable. We may suspend or terminate accounts that violate our Acceptable Use Policy.

8. Third-Party Services and Integrations

8.1 Third-Party Providers

RecipeAI integrates with and relies upon third-party services, including:

• Firebase: Authentication, analytics, and cloud data storage
• Google Cloud Firestore: Database services for storing user data and recipes
• OpenAI: Artificial intelligence models for recipe generation and image analysis
• Stripe: Payment processing and subscription management
• Unsplash/Pexels: Stock food imagery for recipe visuals
• Google Sign-In: OAuth authentication services
• Apple Sign-In: Authentication services for iOS users

8.2 Third-Party Terms

Your use of third-party authentication and payment services is subject to their respective terms of service and privacy policies. RecipeAI is not responsible for the practices or policies of third-party services.

8.3 Service Availability

The availability and functionality of RecipeAI may depend on third-party services. We are not liable for service interruptions, data loss, or functionality issues caused by third-party service failures.

9. Intellectual Property Rights

9.1 RecipeAI Property

The Service, including its software, design, text, graphics, logos, and functionality, is owned by RecipeAI and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

9.2 Trademarks

RecipeAI, the RecipeAI logo, and other marks are trademarks of RecipeAI. You may not use our trademarks without prior written consent.

9.3 User Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without compensation or attribution.

10. Data and Privacy

Your use of RecipeAI is governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy. Please review our Privacy Policy at recipe-ai.io/privacy.html.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting our support team or using the account deletion feature in the application. Upon termination:

• Your access to the Service will be revoked
• Your subscription will be cancelled (if applicable)
• Your data may be deleted in accordance with our Privacy Policy
• No refunds will be provided for unused subscription time

11.2 Termination by RecipeAI

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for:

• Violation of these Terms of Service
• Fraudulent, abusive, or illegal activity
• Non-payment of subscription fees
• Extended periods of inactivity
• Any other reason at our sole discretion

11.3 Effect of Termination

Upon termination, all licenses granted to you under these Terms will immediately cease. Sections of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, and limitations of liability.

12. Disclaimers and Limitation of Liability

12.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, secure, or error-free
• AI-generated recipes will be accurate, complete, or safe
• Defects will be corrected or that the Service is free of viruses
• The Service will meet your specific requirements or expectations
• Any stored content will be preserved without loss or corruption

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RECIPEAI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or goodwill
• Service interruptions or data loss
• Food safety issues, allergic reactions, or health problems
• Inaccurate nutritional information or calorie estimates
• Third-party service failures or data breaches
• Unauthorized access to your account or data

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO RECIPEAI IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12.3 Indemnification

You agree to indemnify, defend, and hold harmless RecipeAI and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload to the Service

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through:

• In-app notifications
• Email to your registered email address
• Updates to the "Last Updated" date on this page

Your continued use of the Service after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must discontinue use of the Service and cancel your account.

14. Geographic Restrictions

RecipeAI is operated from the United States. We make no representation that the Service is appropriate or available for use in all locations. Access to the Service from territories where the content is illegal is prohibited. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

15. Dispute Resolution and Governing Law

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

15.2 Arbitration Agreement

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify. The arbitration will be conducted by a neutral arbitrator in accordance with the American Arbitration Association (AAA) rules.

15.3 Class Action Waiver

You agree that disputes will be resolved individually and not as part of a class, consolidated, or representative action. You waive the right to participate in class actions or class arbitrations.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RecipeAI regarding the Service and supersede all prior agreements.

16.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

16.5 Force Majeure

RecipeAI shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, pandemics, or third-party service failures.
