1. Acceptance of Terms

By downloading, installing, accessing, or using RecipeAI (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. These Terms apply to all users of the Service, including guest users, free users, and premium subscribers.

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or via email. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

2. Eligibility

You must meet the following requirements to use this Service:

• Age Requirement: You must be at least 13 years of age to use this Service. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.
• Legal Capacity: You must have the legal capacity to enter into a binding agreement.
• Compliance: You must not be prohibited from using the Service under applicable law.
• Accurate Information: All information you provide must be accurate, current, and complete.

3. Description of Service

RecipeAI is an artificial intelligence-powered recipe generation and nutritional analysis application that provides:

• AI Recipe Generation: Generate personalized recipes from food images using artificial intelligence;
• Calorie Analysis: Estimate caloric content and nutritional information from food images;
• Recipe Management: Save, organize, edit, and manage recipes;
• Dietary Personalization: Customize recipes based on dietary restrictions, allergies, and preferences;
• Favorites System: Mark and organize favorite recipes for quick access.

4. Account Types and Registration

4.1 Guest Access

The Service offers a guest mode that allows limited access without creating a registered account. As a guest user:

• You may access core features subject to the same daily usage limits as free registered users;
• Your data (including favorites, preferences, and generated recipes) is stored locally on your device only;
• Your data cannot be synced across devices and will be lost if you uninstall the app or reset your device;
• You may convert to a registered account at any time to enable data synchronization;
• You are subject to all other Terms applicable to registered users.

4.2 Registered Accounts

To access full features and enable data synchronization, you may create a registered account using:

• Email and password registration;
• Google account authentication (OAuth);
• Apple account authentication (Sign in with Apple).

When creating an account, you agree to:

• Provide accurate, current, and complete registration information;
• Maintain and promptly update your account information;
• Maintain the security and confidentiality of your login credentials;
• Accept responsibility for all activities that occur under your account;
• Notify us immediately of any unauthorized access or security breach;
• Maintain only one account per person or entity unless we provide written consent.

4.3 Account Security

You are solely responsible for safeguarding your password and account credentials. We will not be liable for any loss or damage arising from your failure to maintain account security or unauthorized access resulting from your negligence.

5. AI-Generated Content Disclaimer

5.1 No Medical or Nutritional Advice

The Service does not provide medical, nutritional, dietary, or health advice. AI-generated calorie estimates, nutritional values, and dietary information are approximations only and may be inaccurate. Always consult qualified healthcare professionals, registered dietitians, or nutritionists before making dietary changes, especially if you have:

• Medical conditions (diabetes, heart disease, kidney disease, etc.);
• Food allergies or intolerances;
• Specific nutritional requirements;
• Eating disorders or related conditions;
• Pregnancy or nursing considerations.

5.2 Accuracy Not Guaranteed

AI-generated content may contain errors, inaccuracies, or omissions. We do not guarantee the accuracy of:

• Recipe ingredients and quantities;
• Cooking times and temperatures;
• Calorie counts and nutritional values;
• Serving sizes;
• Food identification from images.

5.3 Allergy and Food Safety Warning

You are solely responsible for:

• Verifying ingredient safety for your specific dietary needs;
• Ensuring proper food handling, storage, and cooking temperatures;
• Following safe food preparation practices;
• Exercising independent judgment when using any recipe.

5.4 Limitation of Liability for AI Content

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL LIABILITY FOR ANY HARM, INJURY, ILLNESS, ALLERGIC REACTION, OR DAMAGE ARISING FROM YOUR RELIANCE ON AI-GENERATED CONTENT, INCLUDING BUT NOT LIMITED TO RECIPES, NUTRITIONAL INFORMATION, AND CALORIE ESTIMATES.

6. Subscriptions and Payments

6.1 Service Tiers

RecipeAI offers the following service tiers:

• Free Tier: Limited daily usage with access to core features, supported by advertisements;
• Premium Subscription: Unlimited or significantly increased usage limits, ad-free experience, and access to premium features.

6.2 Usage Limits

Free accounts (including guest accounts) are subject to daily usage limits that reset at midnight (UTC). Premium subscribers receive unlimited or significantly higher limits. Specific limits are displayed within the application and may be adjusted at our discretion.

6.3 Rewarded Advertisements

Free users may watch rewarded video advertisements to temporarily extend daily usage limits. This feature is optional and provided through Google AdMob. By watching rewarded ads, you consent to the display of advertisements as governed by our Privacy Policy and Google's advertising policies.

6.4 Subscription Billing

• Subscriptions are billed on a recurring basis (monthly or annually, depending on your selected plan);
• Payment is charged to your Apple App Store or Google Play Store account at confirmation of purchase;
• Prices are displayed in your local currency and may vary by region;
• Prices may change with reasonable notice; price changes will not affect active subscription periods.

6.5 Cancellation

You may cancel your subscription at any time through your device's subscription management:

• iOS: Settings > [Your Name] > Subscriptions > RecipeAI > Cancel Subscription
• Android: Google Play Store > Menu > Subscriptions > RecipeAI > Cancel

Cancellation takes effect at the end of the current billing period. You will retain access to premium features until then. No partial refunds are provided for unused portions of subscription periods.

6.6 Refunds

Subscription purchases are processed through Apple App Store or Google Play Store. Refund requests must be submitted directly to the respective platform in accordance with their refund policies:

• Apple: Request a refund from Apple
• Android: Request a refund from Google Play

6.7 Free Trial

If a free trial is offered:

• You will not be charged during the trial period;
• The trial automatically converts to a paid subscription unless canceled before the trial ends;
• Trial eligibility is limited to one per user, device, or payment account;
• Unused trial time is forfeited upon subscription purchase.

7. Advertising

The free tier of the Service displays advertisements provided by third-party advertising networks, including Google AdMob. By using the free Service, you consent to:

• The display of banner, interstitial, and rewarded video advertisements;
• The collection and use of data for personalized advertising as described in our Privacy Policy;
• Third-party advertising practices governed by their respective privacy policies.

Premium subscribers enjoy an ad-free experience.

8. User Content

8.1 Your Content

You retain ownership of all content you submit to RecipeAI, including photographs, images, recipe modifications, and custom recipes ("User Content"). By submitting User Content, you represent and warrant that:

• You own or have the necessary rights, licenses, and permissions to the content;
• Your content does not violate any third-party rights, including intellectual property rights;
• Your content does not contain illegal, harmful, defamatory, or offensive material;
• Your images are of food and appropriate for recipe generation purposes.

8.2 License to RecipeAI

By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to:

• Process your images through our AI systems to generate recipes and nutritional analysis;
• Store your content on our servers and cloud infrastructure;
• Display your saved recipes and images back to you within the application;
• Use anonymized and aggregated data derived from your content to improve our AI models and Service.

This license terminates when you delete content from your account, except for: (a) content shared with others or made public; (b) backup copies retained for a reasonable period for technical purposes; (c) anonymized data that cannot identify you.

8.3 Content Moderation

We reserve the right to review, remove, or refuse any User Content that violates these Terms, is objectionable, or for any other reason at our sole discretion, without prior notice.

9. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws;
• Upload content that infringes intellectual property rights or violates third-party rights;
• Upload images that are not food-related, inappropriate, or harmful;
• Attempt to reverse engineer, decompile, disassemble, or hack the application;
• Use automated systems, bots, scrapers, or tools to access the Service;
• Circumvent, disable, or interfere with usage limits, security features, or access restrictions;
• Share, transfer, or sell your account credentials to others;
• Create multiple accounts to circumvent usage limits or enforcement actions;
• Resell, redistribute, sublicense, or commercially exploit the Service;
• Upload malicious code, viruses, malware, or harmful content;
• Impersonate any person or entity or misrepresent your affiliation;
• Harass, abuse, threaten, or harm others;
• Interfere with or disrupt the Service, servers, or networks;
• Collect, harvest, or store personal data of other users;
• Use the Service to develop competing products or services.

10. Intellectual Property Rights

10.1 Our Property

The Service, including its software, design, text, graphics, logos, icons, images, audio, video, and functionality, is owned by HomeApps and protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works without our express written permission.

10.2 Trademarks

RecipeAI, the RecipeAI logo, and other marks are trademarks of HomeApps. You may not use our trademarks without prior written consent.

10.3 AI-Generated Recipes

AI-generated recipes are provided for your personal, non-commercial use. You may not commercially redistribute, sell, publish, or claim exclusive ownership or authorship of AI-generated content.

10.4 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback without compensation or attribution.

11. Third-Party Services

11.1 Third-Party Integrations

The Service integrates with third-party services, including:

• Authentication: Firebase Authentication, Google Sign-In, Apple Sign-In;
• Payment Processing: Apple App Store, Google Play Store;
• Advertising: Google AdMob;
• AI Services: Google Gemini for recipe generation and analysis;
• Cloud Infrastructure: Google Cloud Platform, Firebase;
• Analytics: Firebase Analytics.

11.2 Third-Party Terms

Your use of third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the content, practices, availability, or policies of third-party services.

12. Disclaimers

We do not warrant that:

• The Service will be uninterrupted, secure, timely, or error-free;
• Results obtained from the Service will be accurate, reliable, or complete;
• AI-generated recipes will be safe, accurate, or suitable for your needs;
• Defects will be corrected or that the Service is free of viruses or harmful components;
• The Service will meet your specific requirements or expectations;
• Any stored content will be preserved without loss or corruption.

Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions may not apply to you to the extent prohibited by law.

13. Limitation of Liability

This limitation applies to:

• Food safety issues, allergic reactions, illness, or health problems;
• Inaccurate nutritional information, calorie estimates, or recipes;
• Service interruptions, data loss, or corruption;
• Third-party service failures or data breaches;
• Unauthorized access to your account or data;
• Any other matter relating to the Service.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100 USD).

These limitations apply regardless of the legal theory (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the limitation of liability for certain damages. In such jurisdictions, some or all of the above limitations may not apply.

14. Indemnification

You agree to indemnify, defend, and hold harmless HomeApps and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use or misuse of the Service;
• Your User Content;
• Your violation of these Terms;
• Your violation of any applicable law or third-party rights;
• Any claim that your actions caused damage to a third party.

15. Termination

15.1 Termination by You

You may terminate your account at any time by:

• Using the "Delete Account" feature in the app;
• Visiting our Account Deletion page;
• Contacting support@recipe-ai.io.

Upon termination by you, your access to the Service will be revoked, your subscription will be cancelled (if applicable), and your data will be deleted in accordance with our Privacy Policy.

15.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms;
• Fraudulent, abusive, or illegal activity;
• Non-payment of subscription fees;
• Extended periods of inactivity;
• Request by law enforcement or government agencies;
• Discontinuation of the Service.

15.3 Effect of Termination

Upon termination:

• All licenses granted to you under these Terms immediately cease;
• You must delete all copies of the application from your devices;
• No refunds will be provided for unused subscription time;
• Provisions that by their nature should survive termination will survive, including intellectual property rights, disclaimers, limitations of liability, and indemnification.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

16.2 Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that you may bring claims in small claims court if they qualify.

16.3 Class Action Waiver

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.

16.5 European Union Users

For users in the European Union, this section does not affect your statutory rights under EU law or your right to bring claims in your local courts. Nothing in these Terms limits your rights under mandatory consumer protection laws in your jurisdiction.

17. Apple-Specific Terms

If you access the Service through an Apple device, the following additional terms apply:

• These Terms are between you and HomeApps only, not Apple Inc. ("Apple");
• Apple has no obligation to furnish any maintenance or support services with respect to the Service;
• Apple is not responsible for any product warranties, whether express or implied by law;
• Apple is not responsible for addressing any claims by you or any third party relating to the Service or your possession and/or use of the Service;
• Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party intellectual property infringement claims;
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HomeApps regarding the Service and supersede all prior agreements, understandings, and communications.

18.2 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative.

18.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction upon notice to you.

18.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, pandemics, government actions, third-party service failures, power outages, or network failures.

18.6 Notices

We may provide notices to you through the Service, email to your registered address, or other reasonable means. Notices to us should be sent to support@recipe-ai.io.

Section headings are for convenience only and do not affect the interpretation of these Terms.
